A man from Birch Tree was arraigned last week and will have a preliminary hearing this Friday afternoon in Howell County. 49 year old Scott McCarty is charged with first degree statutory rape or attempted rape of a victim younger than 12 and first degree rape or attempted rape of a person younger than 12 and two counts each of first degree sodomy or attempted sodomy of a victim younger than 12 and first degree statutory sodomy, deviate sexual intercourse with a person younger than 12. He also faces charges of first degree endangering the welfare of a child as a parent or guardian by engaging in sexual conduct with a person younger than 17, first offense, and 2 counts of first degree endangering the welfare of a child creating substantial risk, sexual conduct first offense.
