A Lawsuit Has Been Filed Against Police In Ava After A Man Died While Being Arrested Last April

According to reports a woman has filed a lawsuit against the Ava police Department for violating civil rights and for wrongful death. According to the lawsuit an officer responded to a domestic disturbance on April 4, 2020 and found Shane Aumick holding a knife and he was allegedly acting intoxicated. The officer convinced him to put down the knife, the officer then took a pistol from Aumick and handcuffed him. Aumick continued to have alleged delusions and was seeing things and yelling, Aumick was searched while lying on the ground on his stomach. The officer allegedly knelt with his knee on Aumick’s back for several minutes. The encounter was caught of the officer’s body cam. The lawsuit also says that a Cox health paramedic held Aumick’s legs down while the officer was on his back.  Aumick became unresponsive and the paramedic began lifesaving procedures about 30 minutes later Aumick was pronounced deceased.  The lawsuit accuses the Ava Police department and other parties of negligence. Aumick’s wife is seeking compensatory damages and damages for aggravating circumstances against the defendants, punitive damages and attorney fees and court cost.  The defendants in the case are Douglas County, Cox Medical Center, Douglas County emergency management and the paramedic involved.
