The family attorney of Brian Malinowski testified Wednesday before a U.S. House of Representatives subcommittee.

Malinowski was the former director of Clinton National Airport in Little Rock; he was gunned down following a no-knock raid by the ATF, coming to arrest him on charges of being an illegal arms dealer.  Malinowski wasn’t going to comply with their demands and a shootout ensued- he died from his federally-induced injuries two later in an Arkansas hospital.

A week before the March 19 search warrant at Malinowski’s home, ATF was in place at a parking lot and abandoned the attempt to search for him after learning he wasn’t there according to Bud Cummins, Malinowski’s family attorney.

According to the affidavit, Malinowski illegally sold guns from his collection at gun shows. ATF alleged that Milanowski crossed the line for not having his federal firearm license to sell his firearms.

Cummins told U.S House representatives that Malinowski crossing the line is very “murky”.

According to Cummins, body cameras weren’t worn by ATF and Little Rock police officers during the search warrant

According to Sixth Judicial District Prosecutor Will Jones, files are still under review.

Malinowski’s raid is under investigation through the Pulaski County Prosecuting Attorney’s office.

Arkansas Attorney General Tim Griffin is working to stop the implementation of the rules over ATF’s private sellers.
