Jurors in Baxter County were unable to reach a unanimous verdict in the murder trial of 61 year old Robert Dean Penny this week. Penny was charged with first degree murder in the shooting death of 71 year old Chester Hornowski. The jury did find Penny guilty of aggravated assault and armed criminal mischief. and recommended he be sentenced to 12 years in prison and fined $20,000. The judge accepted the recommendation.
