Update on Baxter County FOIA lawsuit

We Have an update on the Freedom of Information Act lawsuit against Baxter County.

According to court filings released in the last week show that some of the documents requested by Matt Campbell of the Blue Hog Report were released. 

The court documents also show that the blogger requested more county records and that 3 circuit court judges have recused themselves from the FOIA situation.

Matt Campbell filed the FOIA complaint against Mickey Pendergrass, Baxter County Judge after the two disagreed on how to settle an FOIA inquiry. The blogger wanted electronic copies of every title to every county vehicle. Judge Pendergrass responded saying that the files were able to be viewed during regular business hours, but Campbell would be charged labor fees if the files had to be electronically sent. Campbell responded by saying that the FOIA does not allow for charges of labor. 

Campbell received the files he originally requested but is still waiting for even more county documents. 

June 2nd, Campbell requested electronic copies of all credit card transactions from January 1st, 2014, to now the Pendergrass was an authorized user of the card, gas card statements for the same time frame, all emails sent to Penderss’s work email since January 1st of 2020, and finally, all non-payroll Baxter County checks signed by Pendergrass since 2014. 

State law requires the person who receives an FOIA request is not the custodian of the files needed to give the requester contact information for the custodian that does host those files.
